The seizure was upheld by Judge Thomas Wingate, who ordered the sites to block access to Kentucky residents or their domains will be seized by the state.

This order has been placed on hold, due to the amount of parties that appealed the decision. A panel of three judges merged all of the appeals into a single case which was heard .

During this session arguments were presented by lawyers that represented the owners of the affected websites, and for Interactive Media Entertainment and gambling Association and the Interactive gambling Council. Counter arguments to this apleal were also presented.

The wording of Kentucky law prohibits the use of “illegal gambling devices,” which are clearly defined as mechanical, manufactured objects. One of the attornies argued that the circuit court had inappropriately extended the definition of “gambling devices” to include a website’s domain name.

An attorney representing the state of Kentucky, argued that a gambling website’s domain gives access to the site, and can therefore be construed as a gambling device.

Another attorney representing the website owners, made the argument that the seizure of domain names is not offered as a remedy in the law being used by Judge Wingate.

And mentioned the jurisdictional issues created by the state of Kentucky exerting punitive control over companies not based in the United States which are licensed and regulated in their home countries. These points are in fact the reason this case has received such a large amount of international attention.

The panel of judges have not yet announced their decison which is expected to be announced in January of next year.
